Judge says deporting migrants to Libya would violate his order

A federal judge has made a ruling stating that deporting noncitizens to Libya without due process would go against his existing court order. This decision comes after reports surfaced that the White House was considering such plans. Lawyers representing a group of migrants took swift action by filing an emergency motion to prevent their deportation to Libya or Saudi Arabia. They cited press reports and firsthand accounts from migrants who claimed they were being prepared for removal to these countries on military aircraft.

The lawyers argued that sending noncitizens to Libya or Saudi Arabia without allowing them to raise concerns about their safety would blatantly defy the court’s preliminary injunction. U.S. District Judge Brian Murphy, who issued the preliminary injunction last month, clarified in his order that any imminent removals to countries like Libya or Saudi Arabia would violate the injunction.

The motion filed by the migrants’ lawyers highlighted the dangers faced by individuals being deported to Libya, including imprisonment, torture, disappearance, and death. They emphasized that due to Libya’s human rights record, it was inconceivable for individuals from other countries to agree to removal to Libya.

The correspondence from two lawyers revealed that clients were coerced into signing documents agreeing to their deportation to Libya. When some individuals refused to sign, they were allegedly handcuffed in separate rooms in an attempt to force compliance.

Reports of potential deportations to Libya come on the heels of the government deporting alleged migrant gang members to El Salvador as part of a multimillion-dollar deal. Despite reaching out to the Trump administration for confirmation, the lawyers had not received any response regarding the deportation plans.

Both President Donald Trump and Department of Homeland Security Secretary Kristi Noem were questioned about the possibility of sending migrants to Libya, with Trump deferring to Homeland Security for answers and Noem stating she couldn’t confirm anything. Libya’s Government of National Unity has denied any involvement in the reported deportations, asserting that they reject the use of Libyan territory for such purposes without their consent.

As of now, officials from the Department of Homeland Security have not provided a response to inquiries from ABC News.
