Atlanta— Todd Burkhalter, a financial adviser based in Georgia, has pleaded guilty to wire fraud in a Ponzi scheme that defrauded more than 2,000 individuals of $380 million, according to federal authorities.

Prosecutors alleged that Burkhalter, the founder and CEO of Drive Planning LLC, engaged in multiple fraudulent investment schemes, using the funds to make extravagant purchases such as a $2 million yacht, a $2.1 million condo in Mexico, and a motorcoach.

The 54-year-old Burkhalter, hailing from St. Petersburg, Florida, enticed investors to participate in schemes promising high returns, including short-term loans to real estate developers with purported 10% quarterly returns. However, these investments were falsely backed by real estate holdings, leading to significant losses for investors who tapped into retirement savings and lines of credit at Burkhalter’s urging.

Former chief operating officer of Drive Planning also pleaded guilty in connection to the scheme, underscoring the breadth of the fraudulent activities perpetrated by Burkhalter and his associates.

“These losses will have lasting repercussions on the lives of the victims long after the defendants are sentenced,” remarked Aaron Seres, a supervisory special agent at the Atlanta FBI office.

As part of a plea agreement, prosecutors are recommending a sentence of more than 17 years in prison for Burkhalter. U.S. Attorney for the Northern District of Georgia, Theodore Hertzberg, highlighted the ongoing efforts to recover victims’ funds through the sale of Burkhalter’s assets, though the likelihood of full restitution remains slim.
