ICE will likely detain Kilmar Abrego Garcia despite judge’s motion to have him released

Kilmar Abrego Garcia is facing the possibility of being placed in Immigration and Customs Enforcement (ICE) custody despite a Tennessee judge’s order for his release in his criminal case. The Salvadoran native, who was mistakenly deported and brought back to the United States from El Salvador earlier this month, is accused of transporting undocumented migrants within the U.S. as part of a conspiracy involving the domestic transport of noncitizens from Mexico and Central America, including children, for financial gain.

U.S. Magistrate Judge Barbara Holmes denied the government’s motion to detain Abrego Garcia, citing a lack of evidence to prove that he poses a serious risk of fleeing or obstructing justice. She also questioned the government’s claims that he is a member of the gang MS-13, pointing out that the evidence presented was hearsay and lacked credibility. Despite the judge’s ruling, Abrego Garcia is likely to be held in ICE custody pending further removal proceedings.

In her 51-page order, Judge Holmes emphasized that Abrego Garcia has no criminal history and that his alleged gang membership is unsubstantiated. She noted that the government’s evidence was based on unreliable testimony from cooperating witnesses. The judge also highlighted that the potential sentence Abrego Garcia faces if convicted is not exceptional compared to other human smuggling cases, with an average sentence of 12 months.

A hearing has been scheduled for Wednesday to determine the conditions of Abrego Garcia’s release. In response to the judge’s order, Acting U.S. Attorney Robert McGuire filed a motion for a stay to prevent his release. Abrego Garcia’s legal battle has been ongoing since his deportation to El Salvador’s CECOT mega-prison in March, despite a court order prohibiting his removal to that country. The Trump administration eventually brought him back to the U.S. to face the criminal charges against him.

The case highlights the complexities of immigration enforcement and the challenges faced by individuals caught in legal limbo. Abrego Garcia’s fate remains uncertain as he navigates the legal system and awaits a resolution to his immigration status.
