Idaho judge wants investigation of information leaks to Dateline in Bryan Kohberger’s quadruple-murder case

The upcoming quadruple-murder trial of Bryan Kohberger in Boise, Idaho has been marred by a potential violation of a gag order. Judge Steven Hippler is determined to identify anyone who leaked information from the investigation to news organizations or other unauthorized sources. This breach of the gag order included details about Kohberger’s internet search history and other sensitive information that was featured in an NBC “Dateline” episode.

Kohberger, a former graduate student at Washington State University, is accused of the stabbing deaths of University of Idaho students Ethan Chapin, Xana Kernodle, Madison Mogen, and Kaylee Goncalves. The bodies of the four victims were discovered in a rental home near the university campus in Moscow, Idaho in November 2022. A not-guilty plea has been entered on Kohberger’s behalf, and the trial is set to commence in August. Prosecutors have indicated that they will seek the death penalty if he is convicted.

Judge Hippler expressed concern that the leak of information could prejudice potential jurors and hinder the fair trial process. He is considering appointing a special prosecutor to investigate the breach of the gag order and identify the source of the leak. The judge emphasized the importance of upholding the integrity of the legal proceedings and ensuring that both the prosecution and defense have a fair trial.

In addition to identifying the source of the leak, Judge Hippler has instructed all parties involved in the case to retain records of any communications they have had with journalists or individuals outside of law enforcement regarding Kohberger or the investigation. This directive is aimed at preserving the integrity of the trial and preventing further unauthorized disclosures of information.

During a pretrial hearing, Judge Hippler discussed the potential violation of the gag order with prosecutors and defense attorneys. He also referenced the “Dateline” episode that featured the leaked information, prompting him to impanel additional alternate jurors for the trial. The judge has requested the attorneys to formally request an investigation into the matter to ensure that justice is served in the upcoming trial.
