Judge in Comey case blocks order mandating DOJ hand over grand jury evidence

The ongoing legal saga surrounding former FBI Director James Comey took a dramatic turn on Monday as a federal judge granted a request from prosecutors to block an order that would have required them to hand over grand jury evidence to Comey’s legal team. The dispute centers around allegations of misconduct and misstatements of the law by Trump-appointed U.S. Attorney Lindsey Halligan during a grand jury presentation in September.

Magistrate Judge William Fitzpatrick, who had initially ordered the disclosure of the grand jury materials, expressed serious concerns about potential violations of Comey’s constitutional rights and a pattern of investigative missteps that could compromise the integrity of the case. In a scathing opinion, Fitzpatrick highlighted the need for transparency and fairness in the prosecution of Comey.

In response to the magistrate judge’s order, the Justice Department requested a stay, which was granted by U.S. District Judge Michael Nachmanoff. The government now has until Wednesday to file objections to the order, with Comey’s attorneys given until Friday to respond.

The legal battle is set to continue as oral arguments are scheduled for Wednesday in Alexandria, Virginia. Comey’s legal team is seeking to have the indictment against him dismissed, alleging that he was targeted for prosecution by the Trump administration as part of a vindictive campaign against political opponents.

Comey, who pleaded not guilty to charges of false statements and obstruction of a congressional proceeding, has been at the center of a high-profile dispute involving Halligan, Trump’s handpicked U.S. attorney. Fitzpatrick’s ruling raised doubts about the handling of the grand jury proceedings and the presentation of the indictment in open court. The judge expressed concerns that the charges may not have been properly deliberated on by the grand jury, casting further doubt on the legitimacy of the case against Comey.
