Kalshi Banned From Operating in State of Massachusetts After Judge Ruling: Report
A recent ruling from Suffolk County Superior Court Judge Christopher Barry-Smith has shaken up the online market prediction platform Kaishi, as he plans to issue a preliminary injunction prohibiting the platform from operating in Massachusetts. The judge’s decision comes after months of legal battles, with Massachusetts Attorney General Andrea Joy Campbell accusing Kaishi of offering sports wagering without a license from the Massachusetts Gaming Commission.
Barry-Smith’s ruling emphasizes the importance of licensure in the state’s sports wagering operations, citing public health and safety concerns, as well as the Commonwealth’s financial interests. The judge is set to finalize the injunction after a hearing on Friday, where he may also consider a temporary pause to allow for an appeal process.
Campbell has raised concerns about Kaishi’s offering of sports wagering to individuals as young as 18, in violation of the state’s regulations that prohibit such activities for anyone under 21. Kaishi, on the other hand, argues that its sports event contracts fall under the jurisdiction of the U.S. Commodity Futures Trading Commission (CFTC) and are not subject to state gaming laws.
The legal battle between Kaishi and Massachusetts highlights the complexities of online sports wagering and the regulatory challenges that come with it. As the case continues to unfold, it will be interesting to see how the platform navigates these legal hurdles and whether they will be able to resume operations in the state.
