Kilmar Abrego Garcia detained at ICE office in Maryland

Kilmar Abrego Garcia, a Salvadoran native, found himself back in the hands of Immigration and Customs Enforcement (ICE) on Monday morning after checking in at their office in Baltimore. This came less than 24 hours after being released from criminal custody in Tennessee. Abrego Garcia, who was wrongly deported in March and later brought back to the U.S. to face new criminal charges, was detained as soon as he entered the ICE office.

His attorney, Simon Sandoval-Moshenberg, expressed frustration at the lack of transparency from ICE officers regarding the reason for Abrego Garcia’s detention and where he would be taken. They were denied access to any paperwork explaining the situation.

Abrego Garcia’s legal troubles began when he was deported to El Salvador in March, despite a court order preventing his deportation to that country due to fear of persecution. The Trump administration claimed he was a member of the criminal gang MS-13, an allegation denied by his family and legal team.

He was brought back to the U.S. in June to face charges of transporting undocumented migrants within the country. Upon release from custody in Tennessee, ICE notified his attorneys of potential deportation to Uganda, prompting his visit to the ICE office in Maryland.

In response to these developments, Abrego Garcia’s attorneys filed a habeas lawsuit accusing the government of violating his rights by not allowing him to express his fears of persecution if deported to Uganda. They also alleged that the government was attempting to punish him for not accepting a plea deal by seeking deportation to a country other than Costa Rica, where he had requested resettlement.

The lawsuit requests that the court block Abrego Garcia from being detained more than 200 miles from the Baltimore courthouse, prevent his removal to Uganda without first attempting removal to Costa Rica, and allow him to undergo a “reasonable fear” interview before any deportation.

The legal battle surrounding Abrego Garcia’s case continues, with his attorneys fighting to protect his rights and prevent his unjust treatment by the government. The outcome of this latest chapter in his saga remains uncertain as the legal proceedings unfold.
