Luigi Mangione top terrorism charges thrown out by judge in state case in massive blow to DA

A recent ruling in Luigi Mangione’s state murder case has resulted in the dismissal of the top charges against him, dealing a significant blow to prosecutors. The judge, Gregory Carro, rejected claims that Mangione could be charged as a terrorist, leading to the dismissal of charges of first-degree murder as an act of terrorism and second-degree murder as a crime of terrorism. However, Mangione still faces a second-degree murder charge for the alleged killing of UnitedHealthcare CEO Brian Thompson outside the company’s investor conference in December 2024.

The ruling means that Mangione could still face 25 years to life in prison in the state case, but not the original 25 years to life without the possibility of parole that he was initially facing. Additionally, Mangione is also facing separate federal charges that carry a potential death penalty.

During a hearing in Manhattan Supreme Court, Carro announced the decision, which was attended by Mangione wearing a tan prison outfit. As he was led out of the courtroom in handcuffs, Mangione glanced towards his supporters, mostly young women, seated in the gallery.

Legal experts had previously criticized the decision to charge Mangione as a terrorist, with some calling it a “reach” and accusing the Manhattan District Attorney of overcharging in an attempt to make headlines. The DA’s office had argued that Mangione’s intent was to intimidate or coerce a civilian population by killing Thompson, a claim that the judge ultimately rejected.

Carro stated that Mangione’s objective, as indicated in his writings, was not to threaten or intimidate but rather to draw attention to what he perceived as the greed of the insurance industry. The University of Pennsylvania graduate is scheduled to appear in court again on December 1 for the state case and on December 5 for the federal case, where the US Attorney plans to seek the death penalty.

The DA’s Office released a statement expressing respect for the court’s decision and confirming that they would proceed with the remaining nine counts, including Murder in the Second Degree. Supporters of Mangione stood in solidarity outside the courthouse, holding signs in his support. Surveillance footage showing the shooting of Brian Thompson outside the Midtown Hilton Hotel was also presented during the proceedings.
