Lululemon sues Costco, alleging the retailer copied its designs

Lululemon, the popular athletic and lifestyle apparel company, is taking legal action against Costco for allegedly selling items that closely resemble its own designs. In a lawsuit filed in the U.S. District Court for the Central District of California, Lululemon claims that Costco’s products imitate its designs to the point of causing confusion among consumers, a practice known as “trade dress” infringement.

According to the lawsuit, some customers mistakenly believe that Costco’s products are authentic Lululemon apparel, while others specifically purchase the knockoff items because they are difficult to distinguish from the real ones. Lululemon emphasizes its commitment to innovation and high-quality construction techniques in setting itself apart in the market, and it is determined to protect its intellectual property rights.

In response to the lawsuit, a Lululemon spokesperson stated that the company takes the protection of its products and intellectual property rights seriously and will pursue legal action when necessary. Costco has not yet responded to requests for comment on the matter.

The items at the center of the dispute include Lululemon’s popular “Scuba” hoodies, “Define” jackets, and “ABC” stretch pants for men. Lululemon’s Scuba hoodie is priced at $118, the Define jacket at $128, and the ABC pants at $128. Costco’s alleged infringing products include items such as the Danskin Ladies Half-Zip Hoodie, Jockey Ladies Yoga Jacket, and Kirkland 5 Pocket Performance Pant.

Lululemon is seeking damages for lost profits and is requesting that Costco cease the manufacturing and distribution of the products that violate its trade dress. The controversy surrounding Costco’s alleged dupes has gained attention in the media and on social media platforms, with users sharing images and videos of the knockoff products using hashtags like #luludupe and #lululemondupes.
