Miami Heat’s Terry Rozier asks judge to throw out betting charges

Miami Heat guard Terry Rozier is currently facing sports gambling charges that have prevented him from playing this season. His lawyers have filed a motion to dismiss these charges, arguing that the government has overreached by turning a private dispute over bettors’ use of non-public information into a federal case.

The motion to dismiss, made public on Tuesday, highlights the defense’s argument that the government’s theory of the case goes against a recent U.S. Supreme Court ruling that narrowed the federal wire fraud statute. Rozier, 31, is accused of aiding gamblers in profiting by providing inside information that he would leave a game early due to an alleged injury in March 2023. This information was then shared with others who placed over $250,000 in prop bets.

Rozier’s lawyers, James M. Trusty and A. Jeff Ifrah, argue that the case has been sensationalized by the government, emphasizing that the bets placed were based on non-public information and violated sportsbooks’ terms of use against wagering on such information. They also question the federal prosecutors’ authority in bringing such a case, noting that sportsbooks are regulated at the state level, not the federal level.

The charges against Rozier are part of a larger crackdown on illegal gambling operations, raising concerns about the integrity of NBA games in the era of legalized betting. The NBA has since adjusted its injury reporting requirements in response to these developments.

Rozier, who pleaded not guilty to wire fraud conspiracy and money laundering conspiracy charges, has been released on bond and is scheduled to appear in court for a hearing on March 3. His lawyers contend that the indictment does not accuse him of placing bets on NBA games or knowingly participating in activities that violated sportsbooks’ terms of service.

Despite the legal challenges, Rozier’s lawyers maintain that he was genuinely injured during the game in question and that the government’s allegations lack merit. The defense team remains confident in their case and is pushing for a dismissal based on the Supreme Court ruling and the lack of federal jurisdiction in the matter.
