The Penrose in RiNo Faces Legal Battle Over Rooftop Bar
The owners of an apartment complex in Denver’s RiNo neighborhood are embroiled in a legal dispute with the rooftop bar on their property. The Penrose, located at 1740 36th St., features a rooftop cocktail lounge named Rose, a basement speakeasy called Thorn, and a ground-floor cafe. However, only Rose has opened its doors, and now faces the threat of eviction.
The conflict arose when Rose owner Ciaran O’Brien sued The Penrose for allegedly cutting off access to the rooftop pool, a move that he claims will severely impact Rose’s business. The landlord, on the other hand, denies ever promising pool access to Rose and has filed a countersuit against O’Brien and his company, Osta Holdings, for breaching the lease agreement.
According to The Penrose, Rose failed to pay rent on time for several months and also hosted an event in an unauthorized area near the parking garage, posing safety concerns. The legal battle has escalated to the point where a full-day hearing is scheduled for Dec. 5 to determine whether Rose will be evicted or granted access to the rooftop pool in the upcoming seasons.
Despite repeated attempts to reach out for comments, O’Brien and his legal team have remained silent on the matter. The outcome of the hearing will ultimately decide the fate of Rose and its presence at The Penrose.
