Trial begins for NYPD sergeant Erik Druan in death of Eric Duprey
Sgt. Erik Duran, an undercover NYPD officer, is currently on trial in Bronx Criminal Court for the death of Eric Duprey, a 30-year-old man who died during a drug bust nearly three years ago. The incident occurred on August 23, 2023, when Duran made a split-second decision to throw a cooler at Duprey, who was riding a scooter at 30 mph down a sidewalk towards Duran and others during the operation.
Defense attorney Andrew Quinn argued during the opening statements that Duran feared for his life and acted in self-defense by throwing the cooler at Duprey. Quinn emphasized that officers are trained to step towards danger and make quick decisions to protect themselves and others. He stated that Duran had only two-and-a-half seconds to make a life or death decision, and he did what was necessary to save lives.
The prosecution, led by the state attorney general’s office, accused Duran of using unnecessary force and causing Duprey’s death. They claimed that Duran threw the cooler at Duprey, causing him to crash into a tree and suffer fatal blunt force trauma to the head. The court heard that Duprey’s head wound was so severe that first responders found pieces of his brain at the scene.
Surveillance footage captured the moment when Duran threw the cooler at Duprey, leading to his tragic death. The prosecution argued that Duran acted recklessly and violently when there was no imminent threat to anyone’s life during the operation. They claimed that Duran’s actions were not justified and accused him of choosing violence instead of de-escalating the situation.
Duran, who pleaded not guilty, has been suspended from the NYPD and placed on modified duty since the incident. The trial has drawn attention from both Duran’s supporters and Duprey’s family, who are seeking justice for their loved one. If convicted of manslaughter, Duran could face up to 25 years in prison.
The outcome of the trial will ultimately depend on Judge Guy Mitchell’s decision, as he will determine whether Duran’s actions were justified in the context of the dangerous situation he faced during the drug bust.
