$11M Southwest Airlines fine waived by DOT

The U.S. Department of Transportation recently made a significant announcement regarding Southwest Airlines’ outstanding fines. The DOT revealed that it would be waiving the remaining $11 million in fines that Southwest Airlines owed as part of a record $140 million penalty imposed on the airline due to its operational meltdown during the 2022 holiday travel season.

According to the updated order released by the DOT this week, Southwest Airlines will receive an $11 million credit instead of having to pay the civil penalty to the government. This credit is in recognition of the airline’s efforts to significantly improve its on-time performance and completion factor through a $112.4 million investment in its Network Operations Control (NOC).

The DOT stated that by waiving the installment, airlines are incentivized to make investments towards enhancing their operations and resiliency, ultimately benefiting customers. This credit structure allows for the public to reap the benefits of the airline’s investment, rather than it resulting in a monetary penalty from the government.

The Biden administration had initially imposed the $140 million civilian penalty on Southwest Airlines in 2023, marking it as the largest penalty ever imposed on an airline in history. The fine required Southwest to upgrade its technology and procedures to improve reliability and compensate passengers for any future cancellations or significant delays caused by the airline.

As part of the penalty, Southwest Airlines was required to pay $35 million to the U.S. treasury in three installments. The final installment of $11 million, which was due on Jan. 31, has now been waived by the DOT.

In response to the announcement, Southwest Airlines expressed gratitude to Secretary Duffy and the DOT team for recognizing the airline’s significant investments in modernizing its operations. The airline highlighted its successful operational turnaround, which has resulted in industry-leading on-time performance and a high percentage of completed flights without cancellations.

During the 2022 holiday season, Southwest Airlines faced challenges due to a massive winter storm, leading to the cancellation of over 16,900 flights and stranding more than 2 million passengers, as reported by the DOT at the time. In addition to the DOT-imposed fine, the airline also agreed to pay approximately $600 million in refunds and reimbursements to customers.

Overall, the decision to waive the remaining fines for Southwest Airlines reflects a recognition of the airline’s efforts to improve its operations and enhance customer experience. This move aims to encourage other airlines to prioritize investments that benefit both their operations and passengers.
