Developer sues Westminster, cites Xcel delays
The developer of high-end apartments near RTD’s Westminster Station, Lux Living, is facing challenges with the city of Westminster due to delays from Xcel Energy. Lux Living purchased city land in 2019 with plans to build The Ivy, a luxurious 146-unit apartment complex with premium amenities. However, Xcel’s delays in providing power to the development have hindered progress.
Despite assurances from Xcel that the power line needed for The Ivy would be completed by October 2025, the work has not yet begun. This delay has triggered a clause in Lux Living’s land purchase agreement, allowing Westminster to repurchase the land if development does not commence. Lux Living is now in a legal battle with the city to prevent the buyback before the power line is installed.
Lux Living claims to have invested $4 million in developing The Ivy and is eager to move forward with construction once the power issue is resolved. The company’s lawyer, Renato Mariotti, emphasizes the importance of collaboration between the developer and the city to find a solution that benefits both parties and the community.
Despite the legal challenges, Lux Living remains committed to bringing The Ivy to fruition in Westminster. The project represents the company’s first venture in Colorado, adding to its portfolio of developments in Missouri. While facing legal issues in Missouri, Lux Living is determined to overcome obstacles and deliver a premium residential experience in Westminster.
