Luigi Mangione escapes death penalty after DOJ decides not to appeal ruling

The decision to remove the death penalty as an option for accused healthcare CEO killer Luigi Mangione has been finalized by Manhattan federal prosecutors. They have chosen not to appeal a judge’s ruling that dismissed the capital punishment charges against the 27-year-old Ivy League graduate.

The U.S. Attorneys Office for the Southern District stated in a letter that they will accept Judge Margarett Garnett’s decision to eliminate the death penalty-eligible murder charge against Mangione due to legal flaws identified in the case. As a result, Mangione will not face the death penalty if he is convicted of the murder of UnitedHealthCare CEO Brian Thompson, who was fatally shot in a targeted attack on a Midtown sidewalk on December 4, 2024.

Despite the removal of the death penalty, Mangione still faces the possibility of life in prison in his upcoming federal trial scheduled to begin in September. He is expected to be charged with “stalking” Thompson, which allegedly led to the CEO’s death. Additionally, Mangione is also facing a separate murder trial in state court set for June.

Throughout the legal proceedings, Mangione has maintained his plea of not guilty to Thompson’s killing. The decision to exclude the death penalty from the federal case was based on the requirement for prosecutors to demonstrate that Mangione committed another “crime of violence” in addition to the murder. Although he was charged with stalking the victim, the judge ruled that stalking does not meet the legal definition of a crime of violence, leading to the dismissal of the death penalty option.

Judge Garnett acknowledged that her ruling may appear perplexing to the general public, but emphasized the importance of following the law in making the decision. Despite the complexities of the case, Mangione will now face the consequences of his actions through the legal system without the possibility of facing the death penalty.
