Midjourney Battles Studios Over AI Use in Copyright Lawsuit
Midjourney, an AI image lab, is currently entangled in a legal battle with major studios including Disney, Universal, and Warner Bros. The studios have accused Midjourney of enabling copyright infringement of their characters through the use of artificial intelligence. In response, Midjourney has invoked the “fair use” defense and claimed that the studios themselves engage in similar AI practices.
However, the dispute has taken a new turn as Midjourney seeks to compel the studios to disclose more information about their AI usage. While a magistrate judge initially limited the scope of discovery to only “consumer-facing” AI applications, Midjourney’s legal team is pushing for access to a wider range of data.
Midjourney’s attorney, Bobby Ghajar, argues that understanding the studios’ internal AI tools and processes is crucial to their defense. They are requesting access to business plans, research reports, training datasets, and other information that would shed light on how AI is used to create and market movies and TV shows.
On the other hand, the studios have only agreed to disclose information about their consumer-facing AI applications, withholding details about internal tools. This discrepancy has led to a legal battle over the extent of disclosure required in the case.
Midjourney’s motion argues that if the studios are using AI models trained on unlicensed copyrighted data for internal purposes, it would demonstrate a widespread industry practice that could impact the outcome of the lawsuit.
Despite the ongoing legal dispute, the studios maintain that their primary goal is to protect their intellectual property rights. They argue that Midjourney’s actions, if proven to be infringing, must be stopped to prevent further unauthorized use of their copyrighted characters.
