Millions of travelers to the U.S. could be charged a new $250 “visa integrity fee”
The United States has implemented a new $250 “visa integrity fee” for many travelers, as part of the tax cuts and spending law signed by President Trump on July 4. This fee is effective for the current federal fiscal year, which runs from October 1, 2024, to September 30, 2025, and will be adjusted for inflation in subsequent years as per the One Big Beautiful Bill Act.
The fee is applicable to visitors entering the U.S. on nonimmigrant visas, such as foreign students attending American universities or workers with temporary work visas like the H-1B visa. In 2023, over 10 million nonimmigrant visas were issued by the U.S. State Department.
According to the new law, visa holders subject to the fee may be reimbursed if they adhere to their visa’s restrictions, such as leaving the U.S. within five days of the visa’s expiration. However, the process for reimbursement and collection of the fee is yet to be specified.
The Department of Homeland Security highlighted the need for cross-agency coordination before implementing the visa integrity fee to restore integrity in the nation’s immigration system. It remains unclear if the fee will be retroactively collected.
Additionally, the new law includes a $100 fee for individuals applying for asylum, adding to the challenges faced by immigrants according to the American Immigration Council. This fee, along with other charges, could make legal pathways unattainable for many individuals.
For instance, student visa applicants already incur an $185 application fee and a $350 fee for the Student and Exchange Visitor Program. With the additional $250 fee, their total cost would reach $785. Asylum seekers, who previously applied for free, may now face filing fees exceeding $1,150 under the new law.
While many tourists entering the U.S. do not require visas under the Visa Waiver Program, which permits residents from over 40 nations to visit for less than 90 days without a visa, the new visa integrity fee will impact those on nonimmigrant visas.
Overall, the implementation of the visa integrity fee and additional charges poses financial challenges for visa holders and applicants, marking a significant change in the U.S. immigration system.
