Vail Wins Appeal to Restrict Delivery Trucks from Pedestrian Malls

A recent ruling by a federal appeals court has given Vail the green light to once again ban delivery trucks from its pedestrian malls, overturning a previous decision that had halted the ban. The 10th U.S. Circuit Court of Appeals determined that Vail has the authority to regulate trucking companies like UPS and FedEx within its town limits, citing exceptions for motor vehicle safety.

The controversial truck ban, which was implemented in 2022 to create a more pedestrian-friendly environment in Vail Village and Lionshead Village, initially faced legal challenges from the Colorado Motor Carriers Association. The association argued that the ban was not based on public safety concerns but rather on aesthetic reasons. However, the recent ruling in favor of Vail paves the way for the town to enforce its loading and delivery regulations.

Despite dissenting opinions from some judges, Vail remains steadfast in its commitment to providing a safe environment for residents and visitors. The town’s leadership sees the truck ban as a necessary measure to reduce vehicular-pedestrian interactions and enhance overall safety in the pedestrian malls.
