Chicago man sexually assaulted woman who mistook his car for her Uber: prosecutors

A Disturbing Incident: Woman Assaulted by Fake Rideshare Driver

A suburban woman’s night out at a concert in Chicago took a horrifying turn when she mistakenly got into the car of a stranger posing as her rideshare driver. The incident ended with her being found partially nude and unconscious on the side of the road by an alert Elmhurst police officer.

Jose Cornelio Evaristo, 42, from Albany Park, now faces serious charges of criminal sexual assault and a DUI after the assault along Route 83 in Elmhurst. The woman had ordered an Uber after the concert and unknowingly got into Evaristo’s car, believing it was her rideshare vehicle. Prosecutors allege that Evaristo assaulted her inside the car before being caught by the police.

When an Elmhurst police officer approached Evaristo’s parked vehicle, he found the woman in a vulnerable state, partially undressed and unconscious. Evaristo was seen with his pants unbuckled and unzipped, indicating suspicious behavior. Evaristo’s blood alcohol content was also at the legal limit for a DUI charge.

DuPage County State’s Attorney Robert Berlin expressed shock and condemnation for the assault, emphasizing the severe impact on the survivor. He assured that the case would be pursued vigorously to deliver justice for the victim.

Following a hearing, Judge Joshua Dieden ordered Evaristo to be detained in custody. The incident serves as a stark reminder of the dangers posed by individuals impersonating rideshare drivers and the importance of verifying the identity of your transportation provider.
