Alibaba sues Pentagon over blacklist designation

Alibaba, the Chinese tech giant, is taking legal action against the Defense Department for labeling it as a military-linked firm. The company has filed a federal lawsuit, claiming that the designation is “arbitrary and capricious.” The lawsuit, filed in federal court in California, challenges the Pentagon’s decision to include Alibaba on a list of companies with ties to the Chinese military.

According to Alibaba, the labeling is unfounded and lacks any basis in fact or law. The company joins other Chinese firms like BYD and Baidu in contesting their inclusion on the list. The Chinese Embassy has also criticized the U.S. for what it sees as an overreach in national security measures targeting Chinese companies.

Alibaba asserts that it is not a Chinese military company and has no involvement in military-civil fusion strategies. The company’s spokesperson stated that the decision to include Alibaba on the list is arbitrary and capricious, prompting them to file a lawsuit demanding removal from the list.

The Pentagon’s designation prohibits new contracts with designated companies or their subsidiaries, starting from June 30. It also limits the ability of these companies to retain lobbying firms in the U.S., which Alibaba argues violates their First Amendment rights. The lawsuit highlights the impact of the designation, noting that advocates who have represented Alibaba in the past are now unable to do so.

Alibaba points out that it is a publicly traded e-commerce and cloud-services provider with a diverse shareholder base that includes major American financial institutions. The company emphasizes its ties to American investors like J.P. Morgan, Citigroup, and BlackRock.

In response to the blacklist, China has imposed export controls on ten U.S. companies involved in defense and rare earths mining. This move escalates tensions between the two countries following a meeting between President Trump and Chinese President Xi Jinping in Beijing aimed at stabilizing relations.

The legal battle between Alibaba and the Defense Department underscores the complex dynamics of international relations and the impact of national security measures on global business operations.
