CFTC is conducting an investigation into Polymarket, source says

The Commodity Futures Trading Commission is currently conducting a thorough investigation into Polymarket, a prediction market platform, as reported by the Wall Street Journal. This investigation comes in the wake of a recent revelation that Polymarket engaged in a deceptive marketing campaign, misleading content creators into thinking they were winning on the platform without actually wagering any money.

According to a source familiar with the inquiry, the CFTC has not disclosed the exact timeline of when the investigation into Polymarket began. Both the CFTC and Polymarket have declined to provide any comments regarding the ongoing investigation.

In response to the Journal’s investigation, Polymarket has taken proactive steps to address the issue. A spokesperson for the company stated that they are conducting a comprehensive audit of all promotional content to ensure compliance with their standards and regulatory disclosure requirements.

This investigation marks a significant turn of events for Polymarket, as the company had previously faced regulatory challenges in 2022 for failing to properly register with regulators. However, investigations by both the CFTC and the Department of Justice were dropped in July of last year without any charges.

Under the leadership of Chairman Michael Selig, the CFTC has been supportive of prediction markets. However, the investigation into Polymarket represents the commission’s first high-profile inquiry into an event contract platform during his tenure.

Polymarket’s CFTC-regulated U.S. exchange was launched in December, allowing domestic users to access the platform once again. The waitlist for accessing the platform was lifted six weeks ago, signaling a positive development for the company.

As the investigation unfolds, it will be interesting to see how Polymarket responds to the regulatory scrutiny and what implications it may have for the future of prediction markets in the U.S. Stay tuned for further updates on this developing story.
