Thousands of immigrants could be eligible for bond hearings, striking down DHS policy: Judge

A recent ruling by a federal judge has overturned a controversial Department of Homeland Security policy that required most immigrants who entered the United States without inspection to remain in detention throughout their removal proceedings. This decision has the potential to impact thousands of immigrants who have been subjected to mandatory detention.

Judge Sunshine Suzanne Sykes in California certified a class that would grant relief to migrants who have entered or will enter the United States without inspection, as well as those who were not initially detained upon entry into the country. The policy, implemented by DHS in July, forced Immigration and Customs Enforcement (ICE) to consider immigrants arrested in the U.S. as “applicants for admission,” thereby eliminating their ability to seek release on bond, regardless of their circumstances.

Prior to this policy, immigrants, even those who entered without inspection, could be eligible for bond and potentially released while their court cases unfolded. However, the new policy stripped them of this option. In response, immigrant rights advocates filed a class action lawsuit on behalf of four individuals detained at an ICE facility in California who were denied consideration for bond.

Following the lawsuit, Judge Sykes issued a temporary restraining order on July 28, preventing the Trump administration from continuing to detain the four named petitioners. Subsequently, the attorneys representing these individuals sought class action relief for others affected by the ICE policy. Lead attorney Matt Adams emphasized the significance of the ruling, stating that anyone within removal proceedings who is being denied a bond hearing due to their method of entry into the country can now seek a bond, as they had been able to for the past three decades.

This ruling marks a significant victory for immigrants caught up in the complex web of detention and removal proceedings. It underscores the importance of due process and access to legal remedies for all individuals, regardless of their immigration status.
