Knesset establishes ‘historic’ law to prosecute Oct. 7 terrorists

The Knesset passed a historic law on May 11, 2026, with a resounding vote of 93-0 in favor. This law provides a legal framework for prosecuting terrorists involved in the Hamas invasion that occurred on Oct. 7, 2023. The legislation outlines the procedures for selecting judges and prosecutors, conducting trials, and the appeals process.

According to the explanatory section of the law, its purpose is to regulate the prosecution of individuals involved in acts of hostility, murder, sexual crimes, kidnapping, and looting carried out by the Hamas terrorist organization and its collaborators during the brutal terrorist attack in 2023.

The law establishes a special military court in Jerusalem dedicated to trying the terrorists responsible for the attack. Among the suspects to be tried are the Nukhba terrorists, the elite Hamas force that led the invasion. It is estimated that there are around 300 Nukhba terrorists currently in Israeli prisons, along with thousands of other terrorists and suspects detained since the outbreak of the war.

Analysts believe that this law will expedite the trial and conviction of the perpetrators of the 2023 massacre, where over 1,200 people were killed, and 251 were taken hostage. Indictments are expected to be brought against 400 suspects, with the possibility of more as investigations continue.

The law has been praised for its potential to bring justice and closure to the victims and their families. By establishing a specialized court and streamlining the legal process, it is hoped that verdicts will be reached within three to five years, significantly faster than the typical timeline for such complex cases.

One of the key provisions of the law allows courts to apply the death penalty for heinous crimes such as murder and rape, which were rampant during the 2023 attack. While some believe the law doesn’t go far enough in ensuring capital punishment for convicted terrorists, it does prohibit the inclusion of these terrorists in any prisoner release deals.

Overall, the law is seen as a crucial step towards holding the perpetrators of the 2023 attack accountable for their actions. It is hoped that the trials will not only deliver justice but also serve as a historical record of the atrocities committed by Hamas.
