Supreme Court rules against Colorado ban on ‘conversion therapy’
The Supreme Court recently made a controversial ruling regarding a law banning “conversion therapy” for LGBTQ+ children in Colorado. This practice, which aims to change a person’s sexual orientation or gender identity, has been discredited and banned in about two dozen states.
In an 8-1 decision, the high court sided with a Christian counselor who argued that the law prohibiting talk therapy infringes on the First Amendment right to free speech. Justice Neil Gorsuch, writing for the majority, stated that the law censors speech based on viewpoint and violates the principles of the First Amendment.
However, Justice Ketanji Brown Jackson dissented, arguing that states should have the authority to regulate healthcare, even if it means restricting speech. She expressed concern that the decision could undermine states’ ability to regulate medical care.
The case is part of a larger trend in which the Supreme Court has supported claims of religious discrimination while displaying skepticism towards LGBTQ+ rights. Counselor Kaley Chiles, supported by the Trump administration, contended that the law prevented her from offering voluntary, faith-based therapy for children. Her legal team argued that the ban hindered parents from finding therapists who would discuss gender identity without affirming transition.
Colorado defended the law by stating that it allows for open discussions about gender identity and sexual orientation, while prohibiting harmful conversion therapy practices. The state argued that therapy is a form of healthcare that should be regulated to protect individuals from harmful practices.
The Alliance Defending Freedom, a conservative legal organization, represented Chiles in the case. The group has been involved in several cases at the Supreme Court that touch on issues of religious freedom and LGBTQ+ rights.
